Incapacity to work: additional information

  • Coverage by the CNS from 01.04.2020 and until the end of the crisis
    • The CNS immediately takes over the monetary compensation due for incapacity for work due to illness and for periods of gradual return to work for therapeutic reasons
    • The employee must send asap his medical certificate to his employer and to the CNS by email (saisiecit.cns@secu.lu), mentioning his personnel number in the subject line of the email
    • If the employee has been absent for a maximum of 1 or 2 days without a medical certificate, the CNS will compensate the employee after receipt of the monthly declaration of incapacity for work made by the employer
    • A statement is sent by the CNS to the employee at the end of the month, showing the details of the payment made
    • Employees having never received a reimbursement from the CNS / change of bank account: it is necessary to complete and return the ad hoc form (https://cns.public.lu/en/assure/demarches/changement-compte-bancaire.html) to comptes.cns@secu.lu with a bank details form (RIB)
    • Special leave (leave for family reasons, accompanying leave and family support leave): such leave is not covered by the procedure set out above (the employer continues to pay the salary and is 100% reimbursed by the Mutualité des employeurs)
  • After the end of the crisis: the employer will be required to provide the employee with a statement giving details of the salary that would have been due for the relevant period under the salary continuation mechanism. In the event of a difference with the compensation paid by the CNS, the employer will be required to pay the supplement

Reimbursement of extraordinary leave for family reasons

  • Payment of salary during leave for family reasons: the employer must continue to pay employees who are on leave for family reasons
  • Reimbursement of leave for family reasons: it is 100% reimbursed by the Mutualité des employeurs. For the month of April, the reimbursement will be made in June at the earliest (by compensation via the social security invoice which will be sent in June)
  • Advance on the reimbursement of the leave for family reasons taken in April: as in March, the social security will make a new advance (mid-May) on the reimbursement of the April leave. The procedure to be followed is as follows:
    • Either the employer has submitted a request for an advance for the month of March (deadline: 08.04.2020 at the latest): in this case, the advance for April 2020 will be automatically transferred to the company’s bank account in mid-May, without any further steps to be taken by the employer
    • Either the employer has not made a request for the month of March: he can now submit a request based on the online form https://www.crf.ccss.lu/ (deadline: 06.05.2020 at the latest) by indicating the unique code communicated by the CCSS (letter of 20 March 2020)
  • Declaration of the CPRF of its employees: based on the usual procedure, the employer must, during the month of May, proceed to the declaration of the incapacity to work for the month of April (exact hours of leave for family reasons) using the type 2 code. On this basis, the CCSS will regularise the advance payment
  • This system of advance payments will be continued until the end of the month of the end of the state of crisis
